The Board of the Homeowners Association suggests that all Brookshire residents read the following important information regarding the Vortens toilet issue.
To all of our Brookshire neighbors and friends,
First, Gary and I want to thank all of those who have been so supportive and helpful through the recent difficulties with our defective toilet/flooding issue in our home as well as the unfortunate loss of my brother on the very same day.
We understand and personally appreciate that many of you here in Brookshire are justifiably upset and concerned about the toilets that you currently have in your homes as well. Some folks are already having their toilets replaced but I would like to make sure that we pass on to you any information that we have learned about this issue.
I have spoken to Vortens several times in the last 2 weeks and as I understand it, the following is the procedure to deal with any possible reimbursement or compensation from them if you do have their toilets in your home…
* First, check on the tank for tank number 3464 or 3412... These are the models they identify as defective and it seems that the date and accompanying 3 digit number stamped inside are not as important.
* Next, if you either are unsure or actually do have one of those models, take photos of your toilet including the Vortens logo and model numbers and send them to support@vortens.com and include your concern along with your name, address, and phone number.
* If you do have the defective model, they may compensate you for part of the cost (up to $200) for each new toilet even if you haven’t had an actual issue. They’ll also offer to direct you to one of their distributors for a replacement Vortens’ tank, but that would have to be your decision.
For those of us that have property damage due to a Vortens’ defective product failurewhich in our case was an overnight spontaneous fracture in the tank that sent hundreds of gallons of water down through our second floor to the kitchen and master bedroom below, the procedure and compensation is only slightly different…
* Photos of all toilets in the home including the failed one with the 3464 or 3412 tank model number should be sent to the same email address, support@vortens.com.
* Also include photos of any cracked or damaged Vortens toilet along with photos of all water damage you may have had.
* Again, be sure to include your name, address and phone number in the email.
* Whether you have had property damage or not, they will then respond with an email confirming if you do have a defective product and ask for copies of the receipts for the replacement toilet(s). In the case of those of us with actual property damage, they will pay up to $250 per toilet in the damaged home and up to $250/toilet toward the plumber’s labor. Sadly, Vortens is leaving all other costs for remediation and property damage repairs up to the homeowner and their homeowner’s insurance. I have three such toilet tanks. One already cracked and caused extensive drywall damage last summer. After reading Teresa’s information I contacted Vortens and received this response:
6/29/2017 “Hi Iggy, please replace all the tanks you may have with our distributor (see the link below) and then send us a copy of the receipts to reimburse, the 3464-V is the part number of your tank that isn't available, you will need to change to the 3412-V or 3436-V tank giving you the same performance and fits perfect with your current bowl, let me know if you have any questions. Ps. We will need you to send us a picture of the manufacture date that is in the inside of the tank, it could be on the side walls or on the back wall of the inside of the tank, some time there is a barcode, that could also help us to get more information about the tank.”
They never addressed the monies already spent as well as the damage. In addition their direction to replace and then wait for reimbursement, to me, is unacceptable.

I took pictures of our toilet tanks & both were 6424's which are the bad tanks. I had Cocalico Plumbing come out this morning to replace two of those defective tanks at a cost of $264. which I didn't think was too bad. I also sent Vorten's pictures of the inside of the defective tanks along with the receipt bill of having them replaced. So we'll see what happens. I sent them pictures before but they said that it wasn't enough that they need the part # on the inside of the bowl. Ha! Well has anybody tried to read any of those numbers? Some are completely obliterated! I had also checked on replacing the whole commode with something different & the first people I checked were Brubaker Plumbing off of Rohrerstown road & they wanted an in-Godley $750+ to replace two toilets. Then checke with another outfit that wanted $350+ to replace two like commodes. I finally decided after hearing about Cocalico plumbing from Mrs. Scanlan that had three replaced that that was the way to go. just replace the tanks! Anway, that's my experience. Final results: Cesar Ortegon Saucedo requested the manufacturing date of my NEW TANKS installed & he told me where to find it. I sent him the dates--6--Feb--2016 Apparently this was all he needed to process my check.
In response to "Iggy" No I just had the tanks replaced by Cocalico Plumbing at $264 for two.

I have not received any information from you since July 4, 2017 when you requested more information, information that we were not told was required at the time we submitted our information. Since then I have heard from several sources in our neighborhood that it seems no matter what has been submitted to your company other information is always required and mostly that information is something that I believe your company knows can no longer be obtained. I believe that your company knew that by the time I submitted my invoice chances are that my old units would be gone and I could no longer obtain the information "required". What I would like from your company is a final determination as to what they are going to do about my case. I received a check from Vortens today. I was really shocked. I understand I am not the only resident to receive a check to please post there is hope for other residents that submitted the required information.

The tank is not the only problem. The master bath toilet bowl is what cracked at our home....all the way from the top to the floor. It was quickly replaced in April, 2017, so no pictures were taken. The other bathroom has the defective model 3464 and both toilets were installed at the same time. The secondary bath toilet is going to be replaced. So, beware if you just replaced the tank. Keep checking the bowl also.

After two months of correspondence with Cesar Ortegon Saucedo, I finally received a check yesterday via FedEx for the full cost of two replacement toilets--$485.48. PTL!

Not sure why my post submitted before it was done, but here goes. I just submitted my invoice to Cesar today for the toilet replacement. I received an email from him that he would only reimburse me for $250, not the total cost. I wrote back stating that since he had already sent full replacement payments to other residents here, I would accept no less. We'll see.
